NARCO Test banned by Supreme Court, Right or Wrong??

In a latest move by Supreme Court, Narco Test, Brain Mapping Test and Polygraph Test has been banned as the Supreme court has found it illegal and violation of the fundamental right of a citizen not to incriminate himself and his right to privacy under Article 20.3 and Article 20.


Let's discuss briefly what these tests are and how these are conducted:-


NARCO TEST: It is basically a test, in which the accused person is induced a sleep-like state that helps overcome resistance to questioning and helps the expert to find out the truth. But during this test an injection, which is given to the suspect is really harmful for his health and it can lead to mental disorder later in future.


POLYGRAPH TEST : It is also known as Lie Detector Test, in which an instrument is used that tracks body indices like blood pressure, pulse, breathing rhythms and skin conductivity. The suspect is asked a series of question and if he lies, then it can be caught by body indices variations.


BRAIN-MAPPING TEST : It is also called Brain Finger-printing. In this test, a sensor is attached to the Suspect's head and then he is made to watch images or listen to sounds usually related to the crime scene. The Sensor monitors electrical activity in the brain and pick up waves that are only generated if the suspect is familiar with the images or sounds.


So, now let's begin how much these tests are useful for the Cops?? Though these tests are scientific in nature and save the suspect to undergo 'Third Degree' by Cops, but so far these tests are widely rejected and questioned by leading experts. In India, so far these tests which were carried out on various suspects didn't give enough clue to the Court the reach to the verdict.


So, bad time for the all the major suspects...............!! Now if they can't say truth to Police in Straight forward way, then They have to undergo "Third Degree" by Police....That will be really tough time for them. You might have seen in the films, how painful it is???


So according to me, With some modification in the these test, it would had go on....because these are the clean test to find out the truth and don't violates the human rights. The modification includes:

• Find out ways to reduce the side effects of the chemical used in Narco test.
• Make some more scientific advancement and suitable changes to make these tests more reliable and trustworthy.
• These tests should be conducted with the Suspect's Consent while keeping in view of their personal health.
